You can contact us at hello@zadzan.com.
2. Eligibility and authority
You must have legal capacity to enter a binding agreement. If you use the services for a company or other organization, you confirm that you are authorized to accept these terms on its behalf.
3. Accounts and security
- Provide accurate and current registration information.
- Keep your login credentials confidential and use a secure device.
- Do not share an account in a way that creates unauthorized access.
- Notify us promptly if you suspect misuse or a security incident.
You are responsible for activity performed through your account unless caused by a failure for which Zadzan is legally responsible. We may require email verification, password reset, or other security measures.
4. Web Builder and user content
The Web Builder lets you create, edit, save, preview, and export website projects. You retain ownership of original content you submit, subject to any third-party rights.
You grant Zadzan a limited, non-exclusive license to host, copy, process, and display your content only as needed to operate, secure, support, and improve the requested services.
- You must have the rights and permissions needed for text, images, logos, code, trademarks, personal data, and other material you upload or use.
- You are responsible for reviewing exported websites, legal notices, accessibility, licenses, claims, and regulatory requirements before publication.
- Templates and generated suggestions are starting points and may require editing for your business, industry, and legal obligations.
5. Acceptable use
You must not use the website or services to:
- Break any applicable law or infringe privacy, intellectual property, contractual, or other rights.
- Upload malware, harmful code, unlawful material, or content you are not authorized to use.
- Attempt unauthorized access, bypass security, probe vulnerabilities, or interfere with service availability.
- Abuse forms, accounts, APIs, automated requests, or other functionality.
- Impersonate others, misrepresent affiliation, facilitate fraud, harassment, or harmful conduct.
- Use generated or hosted content for unlawful discrimination, deception, or decisions requiring qualified professional judgment without appropriate review.
6. Service information and proposals
Website descriptions, timelines, features, and starting prices are general information and may change. They are not a binding quotation unless included in a written proposal accepted by both parties.
A project proposal may define scope, deliverables, assumptions, milestones, revision limits, client responsibilities, fees, taxes, payment schedule, acceptance, support, hosting, and third-party costs.
Changes outside the agreed scope may require additional fees and time. Delays in content, approvals, access, or feedback may change delivery dates.
7. Fees, taxes, and payment
Fees for paid work are stated in the applicable proposal, order, or invoice. Unless that document says otherwise, prices do not include taxes, government charges, app-store fees, domains, paid software, usage-based services, or third-party subscriptions.
Payment obligations, deposits, due dates, refunds, cancellation charges, and late-payment consequences are governed by the applicable written agreement or invoice.
8. Intellectual property
Zadzan and its licensors retain rights in the website, brand, software, templates, design systems, reusable components, tools, methods, documentation, and pre-existing materials.
Ownership or licensing of custom project deliverables will be stated in the project agreement. Unless expressly transferred in writing and subject to full payment, no ownership transfer is implied.
Third-party software, fonts, libraries, images, platforms, and services remain subject to their own licenses and terms.
9. Third-party services
Our services may connect to hosting companies, email services, app stores, payment services, AI providers, APIs, social networks, maps, analytics tools, or other third parties. Their availability, pricing, data practices, and terms are controlled by those providers.
Zadzan is not responsible for third-party changes, outages, suspensions, or decisions beyond our reasonable control, but we will provide reasonable assistance where included in an agreement.
10. Availability, changes, and support
We may update, secure, suspend, or discontinue website functionality. We do not promise uninterrupted or error-free availability.
Support, maintenance, backups, hosting, response times, and service levels are included only when stated in an applicable plan or agreement.
11. Confidentiality
Where either party receives non-public business, technical, or commercial information in connection with a project, each party should use reasonable care to protect it and use it only for the agreed purpose, subject to any more specific confidentiality agreement and lawful disclosure requirements.
12. Disclaimers
To the extent permitted by law, the public website, free tools, templates, previews, and general information are provided on an “as available” basis. Results depend on your content, market, implementation, third-party services, and other factors.
Zadzan does not provide legal, tax, medical, financial, cybersecurity certification, or other regulated professional advice unless expressly agreed and delivered by a properly qualified professional.
13. Limitation of liability
Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited.
To the extent permitted by law and unless a signed agreement provides otherwise, Zadzan will not be liable for indirect, incidental, special, punitive, or consequential loss, or loss of profits, revenue, data, goodwill, or business opportunity arising from free website use or events outside our reasonable control.
Any project-specific liability limits will be set out in the applicable signed agreement.
14. Suspension and termination
We may restrict or suspend access where reasonably necessary to protect security, investigate misuse, comply with law, address non-payment under an agreement, or prevent material harm.
You may stop using the public website at any time. Project cancellation, account closure, data export, deletion, and refund rights are subject to the applicable agreement, this policy, and applicable law.
15. Governing law and disputes
These terms are governed by the laws and regulations of the Kingdom of Saudi Arabia. The competent courts of Saudi Arabia will have jurisdiction unless an applicable written agreement lawfully provides another dispute process.
Please contact hello@zadzan.com first so we can try to resolve a concern promptly.
16. Language, changes, and general terms
The Arabic version is the primary version for interpretation in the event of a conflict with an English translation.
We may update these terms by posting a revised version and effective date. Continued use after the effective date constitutes acceptance where permitted by law.
If a provision is unenforceable, the remaining provisions continue in effect. Failure to enforce a provision is not a waiver. You may not transfer your rights or obligations without our written consent; Zadzan may transfer these terms as part of a lawful reorganization or transfer of its business.
